Privacy Policy
Nhithuongthu Pty Ltd is committed to respecting your privacy and handling your personal information openly, transparently and in accordance with Australian law.
This Privacy Policy explains how Nhithuongthu Pty Ltd (ABN 65 702 561 279) collects, holds, uses and discloses personal information. It applies to our website at nhithuongthu.online and to the import, export and trading services we provide from Melbourne VIC to clients across Australia. The policy is written having regard to the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles (APPs).
1. Who we are
Nhithuongthu Pty Ltd is an Australian proprietary company registered under ABN 65 702 561 279. We are based in Melbourne VIC and provide import, export and trading services, including sourcing coordination, supplier and buyer introductions, freight coordination and customs documentation support. In this policy, "Nhithuongthu", "we", "us" and "our" refer to Nhithuongthu Pty Ltd.
2. Personal information we collect
The types of personal information we commonly collect include:
- identity and business contact details — for example, your name, position or role, business email address and business postal address;
- company and trading details — for example, your business name, ABN or ACN, industry sector and preferred trading terms;
- enquiry and quotation details — for example, the goods, quantities, origin or destination markets and timeframes you ask us about;
- transaction and logistics details — for example, purchase and sale records, consignment and shipping instructions, and customs and biosecurity documentation relating to your goods;
- credit and invoicing details where you engage us on trading terms — for example, billing contacts, purchase order numbers and payment records;
- correspondence — for example, records of emails, messages and meetings with you or your representatives; and
- website usage information — for example, pages viewed, referring websites and general location data collected through cookies and analytics tools.
We do not actively solicit sensitive information. If you provide documents that contain sensitive information (for example, for customs or biosecurity purposes), we will handle that information in accordance with the APPs and only for the purpose for which it was provided.
3. How we collect personal information
We usually collect personal information directly from you, when you submit an enquiry or quotation request through our website, correspond with us by email, or negotiate trading arrangements with our team.
We may also collect personal information from third parties, such as your nominated freight forwarders, customs brokers, overseas suppliers or buyers, banks, insurers, referral partners who introduce you to us, and credit reporting bodies where permitted by law. Some website usage information is collected automatically through cookies and analytics tools as described in section 11.
4. Why we collect, hold, use and disclose personal information
We collect, hold, use and disclose personal information for purposes including:
- responding to enquiries and preparing quotations;
- providing our import, export and trading services, including coordinating freight and preparing or reviewing customs and biosecurity documentation;
- establishing and managing client accounts, orders, invoicing and credit arrangements;
- verifying identity and trading details where required by law or prudent commercial practice;
- complying with Australian laws and the directions of agencies such as the Australian Border Force and the Department of Agriculture, Fisheries and Forestry;
- maintaining business records, managing disputes and protecting our lawful interests;
- improving our website, services and client communications; and
- direct marketing, where permitted under APP 7 (you may opt out at any time).
We will not use or disclose personal information for a secondary purpose unless you would reasonably expect that use or disclosure, you have consented, the use or disclosure is required or authorised by law, or another exception under the APPs applies.
5. Disclosure of personal information
Depending on the services we provide to you, we may disclose personal information to:
- freight forwarders, shipping lines, airlines, and road or rail carriers engaged to move your goods;
- customs brokers, and government agencies such as the Australian Border Force and the Department of Agriculture, Fisheries and Forestry, where required to clear or move goods;
- banks, financial institutions, payment providers and insurers involved in your transactions;
- professional advisers, including accountants, auditors and lawyers;
- information technology, hosting and email service providers that support our operations; and
- government bodies, regulators or courts where disclosure is required or authorised by law.
We do not sell or rent personal information, and we do not disclose it for unrelated third-party marketing purposes.
6. Overseas disclosure
Because our work involves international supply chains, we may disclose personal information to recipients located outside Australia — for example, overseas suppliers or buyers, international freight partners, and cloud service providers whose servers may be located overseas. Where we disclose personal information to an overseas recipient, we take reasonable steps, as required by APP 8, to ensure the recipient handles that information consistently with the APPs.
7. Anonymity and pseudonymity
Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym — for example, when making a general enquiry about our services. However, it will usually be impracticable to provide import, export or trading services anonymously, because customs, biosecurity and payment processes require verified identity and trading details.
8. Data quality
We take reasonable steps to ensure the personal information we collect, use or disclose is accurate, up to date, complete and relevant. You can help us by letting us know if your details change — simply email ceo@nhithuongthu.online.
9. Data security and retention
We hold personal information in electronic records and take reasonable steps to protect it from misuse, interference, loss and from unauthorised access, modification or disclosure. Measures include access controls, encrypted connections for data in transit, and confidentiality obligations for our team and service providers.
We keep personal information only for as long as it is needed for the purposes set out in this policy, including record-keeping obligations that apply to trade transactions (customs and commercial records are generally kept for at least five years). When information is no longer required, we take reasonable steps to de-identify or securely destroy it.
10. Access to and correction of personal information
You may request access to the personal information we hold about you, or ask us to correct information you believe is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, email ceo@nhithuongthu.online. We will respond within a reasonable period and, in most cases, there is no charge.
In limited circumstances, we may decline a request where an exception under APP 12 or APP 13 applies. If we do so, we will explain our reasons and, where relevant, take reasonable steps to associate a statement with the information noting the correction you claim.
11. Cookies and website analytics
Our website uses cookies and similar technologies to keep the site working properly, remember preferences and understand how visitors use the site through de-identified analytics. Most browsers allow you to refuse or delete cookies through your settings; doing so may affect some features of the website. We do not use cookies to build profiles that identify individual visitors.
12. Direct marketing
We may use your contact details to send information about our services where you have consented, or where you would reasonably expect it and you have not asked us not to. Every marketing message includes a simple way to opt out, and you can also ask us to stop at any time by emailing ceo@nhithuongthu.online. We will act on your request promptly and free of charge.
13. Notifiable Data Breaches
The Notifiable Data Breaches scheme in the Privacy Act requires us to notify the Office of the Australian Information Commissioner (OAIC) and affected individuals if we experience an eligible data breach that is likely to result in serious harm. We maintain internal procedures to identify, assess and, where required, report such breaches without unreasonable delay.
14. Complaints and feedback
If you have a concern about the way we have handled your personal information, or believe we may have breached the APPs or this policy, please email ceo@nhithuongthu.online with the subject line "Privacy Complaint". We will acknowledge your complaint promptly and aim to provide a written response within 30 days.
If you are not satisfied with our response, you may lodge a complaint with the OAIC. For further information, visit www.oaic.gov.au.
15. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices, the services we offer or Australian privacy law. The current version will always be published at nhithuongthu.online/privacy.html. This policy should be read together with our Terms of Use.
